Digital Millennium Copyright Act (DMCA) Policy
Understanding the DMCA
The Digital Millennium Copyright Act (DMCA) establishes a structured process for copyright holders to request the removal of infringing content. For comprehensive information about the DMCA, we recommend visiting the U.S. Copyright Office’s official website.
Please note that this policy is for informational purposes only and should not be considered legal advice. We strongly advise consulting with a legal professional for specific questions or situations regarding copyright issues.
Submitting a DMCA Takedown Notice
If you believe that your copyrighted work is being used on jscalco.com without authorization, please submit a DMCA takedown notice to our designated agent. Your notice must include the following information:
- Your physical or electronic signature (full name is sufficient for electronic submissions).
- Identification of the copyrighted work claimed to be infringed (e.g., a link to your original work or a clear description).
- Identification of the allegedly infringing material on jscalco.com, with sufficient information for us to locate it.
- Your contact information, including address, phone number, and email address.
- A statement of your good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Send your DMCA takedown notice to: support at jscalco.com or through our contact page here
Important Considerations Before Submitting a Notice
- Accuracy of Information: The DMCA requires that you swear to the facts in your notice under penalty of perjury. Providing false information can have serious legal consequences, including criminal charges and civil liability.
- Thorough Investigation: Before submitting a takedown request, conduct a comprehensive investigation and consider consulting with an attorney. Ensure that the use of the content is not permissible under fair use or other legal doctrines.
- Direct Contact: As a first step, we recommend attempting to contact the user directly to resolve the issue before submitting a formal DMCA notice.
- No Automated Submissions: Each takedown notice should be evaluated by a trained professional. We do not accept notices generated by automated bots.
Counter-Notice Procedure
If you believe your content on jscalco.com was wrongly disabled due to a DMCA takedown request, you have the right to submit a counter-notice. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the content that was removed and its former location on jscalco.com.
- A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
- Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction] and will accept service of process from the person who provided the original DMCA notification.
Send your counter-notice to the same contact information provided for DMCA takedown notices.
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant doesn’t notify us of a lawsuit within 14 days, we may reinstate the removed content.
Repeat Infringers
jscalco.com maintains a policy of terminating accounts of users who are subject to repeated, valid DMCA takedown notices.
Modifications to This Policy
We reserve the right to modify this DMCA policy at any time. Regular review of this policy is recommended to stay informed of any changes.
